These Terms of Service (“Terms”) govern your use of mroutdoorliving.com (the “Website”) operated by Mr. Outdoor Living® (“we”, “us”, “our”). By accessing or using the Website, or by submitting a contact, consultation, or estimate request, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

Important: These Terms govern website use and your initial inquiry only. Any installed project (patio, outdoor kitchen, pergola, drainage, lighting, planting, or other service) is governed by a separate written proposal and contract that you sign before work begins. In the event of any conflict between these Terms and a signed project contract, the project contract controls for that project.

2. Who We Are and What We Do

Mr. Outdoor Living® is a licensed North Carolina general contractor specializing in outdoor living, landscape construction, hardscapes, outdoor kitchens, water features, fire features, lighting, drainage, plantings, and irrigation in the greater Charlotte region and surrounding Carolinas communities. 3. Using the Website

You may use the Website for lawful personal and business purposes related to evaluating, requesting, or engaging our services. You agree not to:

  • Use the Website to transmit unlawful, harassing, defamatory, or infringing content;
  • Attempt to access any area of the Website not intended for public use, or interfere with its operation or security;
  • Scrape, mirror, or harvest content for republication without our prior written consent;
  • Submit false, misleading, or fraudulent inquiries (including impersonation or automated form submissions).

We reserve the right to refuse service, terminate access, or decline any inquiry at our sole discretion.

You may not reproduce, republish, or use our content for commercial purposes without our prior written permission.

Third-party trademarks referenced on the Website (for example, Belgard®, Techo-Bloc®) remain the property of their respective owners and are used solely to identify products we install.

5. Inquiries, Estimates, and Consultations

When you submit a contact form, request a consultation, or ask for an estimate:

  • You authorize us to contact you by phone, text, or email at the numbers and addresses you provided, for the purpose of responding to your inquiry and scheduling any requested consultation.
  • An on-site consultation or preliminary quote is not a binding offer to perform work. A binding agreement exists only upon a signed written proposal or contract.
  • Prices or ranges published on the Website are illustrative and may change without notice. Actual pricing depends on site conditions, selected materials, design scope, and scheduling.

This disclaimer applies to website use only. Warranties on installed work are governed by your signed project contract and by our separate Warranty.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MR. OUTDOOR LIVING® WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). This section does not limit liability that cannot be limited under applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Mr. Outdoor Living®, its officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Website.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Website shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the jurisdiction and venue of those courts.

Disputes arising out of an installed project are governed by the dispute resolution terms of your signed project contract, which may include mediation or arbitration through Miles ADR as described on our Policies page.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Website after changes take effect means you accept the revised Terms.
